Participation Terms, Waiver & Liability Notice
By registering, enrolling, making payment for, or allowing your child to participate in any activity organised by Foundation Football, you agree to the following Participation Terms.
1. ASSUMPTION OF RISK
1.1 The Parent acknowledges that participation in football and related activities involves inherent and significant risks, including but not limited to:
Physical injury (minor and severe)
Concussion and head trauma
Fractures, sprains, ligament damage
Heat exhaustion or heat stroke
Cardiac events
Permanent disability
Death
1.2 Risks may arise from:
Physical contact with other participants
Coaching drills and match play
Equipment use
Surface conditions (including wet or uneven pitches)
Weather conditions including lightning, heat, haze
Acts or omissions of other participants
Acts or omissions of third-party venue operators
1.3 The Parent voluntarily and expressly assumes all such inherent risks associated with participation.
1.4 Foundation Football is committed to providing a safe, structured and professionally supervised training environment. However, no sporting activity can be made entirely risk-free.
2. RELEASE OF LIABILITY
2.1 To the fullest extent permitted under the laws of Singapore, the Parent and Participant release and discharge Foundation Football and its:
Directors
Shareholders
Employees
Coaches
Contractors
Volunteers
Agents
Partner schools
Venue operators
Sponsors
from liability for loss or damage arising from participation, except where such liability cannot lawfully be excluded.
2.2 Nothing in this agreement excludes or restricts liability for:
Death or personal injury caused by negligence (as prohibited under Singapore law),
Fraud,
Wilful misconduct.
2.3 Subject to Clause 2.2, Foundation Football shall not be liable for:
Accidental injury
Loss of personal property
Economic loss
Emotional distress
Loss of opportunity
Reputational harm
Indirect or consequential loss of any kind.
3. LIMITATION OF LIABILITY
3.1 Where liability cannot be excluded, Foundation Football’s total aggregate liability shall not exceed: The total programme fees paid by the Participant in the three (3) months preceding the claim.
3.2 This limitation applies whether claims arise in:
Contract
Tort (including negligence)
Statute
Equity
Any other legal basis
4. INDEMNITY
The Parent agrees to be responsible for and indemnify Foundation Football against any third-party claims arising from the Participant’s conduct:
Third-party claims
Claims brought by family members
Claims arising from the Participant’s conduct
Property damage caused by the Participant
Legal costs incurred defending such claims
This indemnity survives termination of participation.
5. PROFESSIONAL INDEMNITY PROTECTION
5.1 Coaching and instruction are provided using reasonable care and skill.
5.2 Foundation Football makes no representation or guarantee regarding:
Athletic development
Selection to teams
Competitive outcomes
Scholarships
Advancement opportunities
5.3 Coaching does not constitute medical, physiotherapy, therapeutic, or healthcare advice.
5.4 Parents are responsible for obtaining independent medical advice regarding participation suitability.
6. MEDICAL FITNESS & DISCLOSURE
6.1 The Parent warrants that:
The Participant is medically fit to participate.
All medical conditions have been fully disclosed.
6.2 Failure to disclose relevant medical information releases Foundation Football from liability arising from undisclosed conditions.
6.3 In emergency situations, Foundation Football is authorised to:
Administer basic first aid
Contact emergency services
Arrange hospital treatment
All medical costs remain the Parent’s responsibility.
7. INSURANCE DISCLAIMER
7.1 Foundation Football may maintain insurance policies including:
Public Liability Insurance
Professional Indemnity Insurance
Group Personal Accident Insurance
7.2 Such insurance:
Does not create automatic entitlement to compensation.
Does not override this agreement.
Is subject to insurer terms and exclusions.
7.3 Any insurance maintained by Foundation Football is subject to policy terms, exclusions and insurer assessment. Parents are strongly advised to maintain independent medical and personal accident insurance.
8. THIRD-PARTY VENUES
8.1 Activities may occur at third-party venues (e.g. schools, private clubs, sports halls).
8.2 Foundation Football is not responsible for:
Structural defects beyond reasonable control
Security arrangements of venue operators
Acts of third-party venue staff
Participants must comply with all venue rules.
9. OFF-SITE EVENTS & TRAVEL
9.1 Participation in tournaments, camps, or off-site activities is voluntary.
9.2 Travel to and from venues is at the Parent’s own risk unless transport is directly operated by Foundation Football.
9.3 Foundation Football is not liable for third-party transport providers.
10. PERSONAL PROPERTY
Foundation Football is not responsible for loss, theft, or damage to personal belongings, equipment, or valuables brought to sessions.
11. FORCE MAJEURE
Foundation Football shall not be liable for failure to perform due to:
Government restrictions
Pandemic or epidemic
Lightning warnings
Haze
Severe weather
Venue closure
Acts of God
Civil unrest
Sessions may be rescheduled or credited at our discretion.
12. CODE OF CONDUCT (PARENTS & PARTICIPANTS)
Foundation Football may suspend or terminate participation (without refund) for:
Aggressive or abusive behaviour
Harassment of staff
Sideline interference
Public statements or conduct that materially harms the Academy or its staff
Bullying
Non-payment
Breach of this agreement
13. PAYMENT & REFUNDS
13.1 Fees are payable in advance.
13.2 Fees are generally non-refundable for absences, illness, withdrawal or schedule conflicts, unless otherwise agreed at the Academy’s discretion.
13.3 No refunds for:
Absences
Illness
Withdrawal
Schedule conflicts
13.4 Chargebacks or disputed payments may result in legal recovery proceedings.
14. MEDIA RELEASE
14.1 During training sessions, matches, camps and events, photographs or video recordings may be taken for:
Coaching review and development
Internal documentation
Marketing and promotional purposes (e.g. website, social media, brochures)
14.2 By enrolling, the Parent acknowledges that incidental capture of the Participant in group images may occur.
14.3 Optional Marketing Use Consent
Foundation Football will only use identifiable images of the Participant for public marketing purposes where consent has been provided.
Parents may:
Provide consent at registration; or
Withdraw consent at any time by written notice to the Academy.
14.4 Upon written opt-out, Foundation Football will take reasonable steps to:
Cease future publication of identifiable images; and
Remove images from future marketing materials where practicable.
14.5 Opt-out requests will not affect images already lawfully published prior to withdrawal.
15. DATA PROTECTION (PDPA)
15.1 Personal data is collected for legitimate operational purposes including:
Registration and administration
Emergency contact
Programme communication
Safety management
Billing and payment
15.2 Foundation Football does not sell personal data.
15.3 Personal data will not be disclosed to third parties except:
Where necessary for programme operations (e.g. venue operators, insurers);
Where required by law; or
Where separate marketing consent has been provided.
15.4 Parents may request access to or correction of personal data in accordance with the Personal Data Protection Act (Singapore).
16. SEVERABILITY
If any provision is deemed unenforceable under Singapore law, remaining provisions remain valid.
17. GOVERNING LAW & JURISDICTION
This agreement shall be governed by the laws of the Republic of Singapore.
The parties submit to the exclusive jurisdiction of the Singapore courts.
18. ENTIRE AGREEMENT
This document constitutes the entire agreement between the parties and supersedes all prior representations.
19. ACKNOWLEDGEMENT
19.1 These Participation Terms form part of the contractual agreement between Foundation Football and the Parent.
19.2 The Parent acknowledges that these terms are made available:
On the Academy website;
During registration;
Prior to payment; and/or
Prior to participation in any activity.
19.3 The Parent agrees that acceptance of these terms occurs upon the earliest of:
Completion of registration;
Submission of a signed form (physical or electronic);
Ticking of an acceptance checkbox (where implemented);
Payment of programme fees; or
Attendance at any training session, camp, match or event.
19.4 Where a digital acceptance checkbox or electronic signature is used, such acceptance shall constitute conclusive evidence of agreement.
19.5 Where no checkbox or signature is used, participation after reasonable notice of these terms shall constitute deemed acceptance.
19.6 The Parent confirms that they have had reasonable opportunity to read and understand these terms prior to participation.
